THE ESSENTIALS
Cancellation by you — More than 7 days before: fully refunded. Between 7 days and 48 hours: 50% remains due. Less than 48 hours or no-show: 100% remains due.
Illness or accident — With a medical certificate provided within 30 days, unused sessions are refunded less a 10% administrative fee.
Weather — Sessions run in all conditions. Only an official closure of the ski area or trails constitutes grounds for cancellation.
Payment — An invoice is issued within 72 hours of confirmation, payable by bank transfer or online.
The full terms below apply to every booking.
ARTICLE 1 — Scope and definitions
These General Terms and Conditions govern all services provided by Apex Alps SA ("APEX"), a company registered in Crans-Montana, Valais, Switzerland, to any natural or legal person booking a service ("the Client").
"Services" means all ski, snowboard, mountain bike, e-bike, hiking and multi-sport instruction, guiding, camps and associated services offered by APEX, whether private or in a group, in summer or winter.
"Participant" means any person taking part in a Service, whether or not they are the Client.
Booking a Service implies full and unreserved acceptance of these Terms. Any conflicting condition put forward by the Client is unenforceable against APEX unless expressly accepted in writing.
ARTICLE 2 — Booking and formation of contract
Bookings may be made through the APEX website, by email, by telephone, or through a partner hotel or concierge acting on the Client's behalf.
A booking is confirmed, and the contract formed, only upon written confirmation issued by APEX. A booking request alone does not constitute a contract.
Where a booking is made by a hotel, chalet or concierge service on behalf of a guest, that partner acts as the Client's agent. Invoicing may be addressed to the partner where agreed in advance.
The Client is responsible for the accuracy of the information provided at booking, in particular the number, age and ability level of Participants. APEX may adjust or refuse a Service where the information provided proves materially inaccurate.
ARTICLE 3 — Prices and payment
Prices are stated in Swiss francs (CHF) and are those in force at the date of booking.
Unless expressly stated otherwise, prices do not include lift passes, meals, transport, personal equipment, or protective gear beyond what is specified for each Service.
An invoice is issued within 72 hours of booking confirmation and is payable by bank transfer or through the online payment link provided. Where the Service is adjusted, an updated invoice is issued.
Equipment rented through Specialized Crans-Montana is invoiced separately by that partner and is not included in the APEX invoice.
Late payment may result in the suspension of the Service, without prejudice to APEX's right to claim default interest at the statutory rate.
ARTICLE 4 — Cancellation by the Client
Any cancellation must be notified to APEX in writing.
— More than 7 days before the start of the Service: no charge, full refund of any amount paid.
— Between 7 days and 48 hours before the start of the Service: 50% of the price remains due.
— Less than 48 hours before the start of the Service, or non-attendance ("no-show"): 100% of the price remains due.
In the event of illness or accident duly evidenced by a medical certificate, unused sessions are refunded less a 10% administrative fee, provided the certificate is submitted within 30 days.
A Service that has begun is neither refundable nor interruptible in exchange for a partial refund, save at APEX's discretion as a commercial gesture.
ARTICLE 5 — Cancellation insurance
APEX strongly recommends that each Client take out cancellation and interruption insurance covering illness, accident and closure of the ski area, with an insurer of their choice.
In the absence of such cover, the Client alone bears the financial risk associated with a late cancellation or an interruption of the Service for medical reasons.
ARTICLE 6 — Cancellation, modification or postponement by APEX
APEX reserves the right to cancel, postpone or modify a Service in the following circumstances: weather conditions making the activity dangerous, official closure of the ski area or trails, insufficient numbers for a group session, force majeure, or a demonstrable risk to the safety of Participants or instructors.
Except in the case of a complete and official closure of the area or site concerned, weather conditions do not in themselves constitute grounds for cancellation: Services take place in all weather, subject to applicable safety rules, and an alternative programme may be offered (sheltered location, indoor activity, theoretical content).
Where a Service cannot take place due to APEX, the Client is offered, at their choice: a postponement, a credit note valid for 24 months, or a full refund of the portion not performed.
For group sessions, a minimum number of Participants may be required to open a level. Below that threshold, APEX will offer an alternative (private session at an adjusted rate, combining of levels, or a refund), with no further compensation due.
ARTICLE 7 — Conduct of the Service
Participants must be present at the meeting point 15 minutes before the stated start time, equipped and ready.
Late arrival does not extend the Service; the session ends at the scheduled time. A delay exceeding 30 minutes without notice may be treated as a no-show.
APEX allocates instructors according to level, language and availability. APEX reserves the right to change the instructor assigned, without this affecting the validity of the contract.
The instructor decides on the terrain, the route and the content of the session, in the interests of safety and progression. The instructor may exclude, at any time and without refund, any Participant whose behaviour endangers themselves, the group or the instructor, or who is under the influence of alcohol or narcotics.
ARTICLE 8 — Safety and liability
APEX undertakes an obligation of means, not of result. Mountain sports carry inherent risks which the Client and Participants acknowledge and accept.
APEX holds professional liability insurance in accordance with the requirements of the Canton of Valais. APEX's liability is limited to cases of proven fault on its part and, in any event, to the amount covered by that insurance.
APEX declines all liability for: accidents resulting from a Participant's failure to follow the instructor's instructions; damage to or theft of personal belongings; injuries occurring outside the Service; and consequences of a pre-existing medical condition not disclosed at booking.
Participants must be covered by their own accident insurance and, where applicable, mountain rescue cover. This is the Client's responsibility.
The Client must inform APEX at booking of any medical condition, allergy or treatment relevant to the safe conduct of the Service.
ARTICLE 9 — Equipment and specific rules
Helmets are compulsory for all Participants in all bike Services and for all minors in snow Services. APEX reserves the right to refuse participation to anyone not wearing one.
Equipment supplied by APEX or its partners must be returned in the condition in which it was received. Any damage resulting from misuse is chargeable to the Client.
E-bikes: under Swiss law, e-bikes may not be used by riders under 16 years of age. This rule admits no exception. For younger children, a towing system on a conventional bike may be offered at the guide's discretion.
Downhill: lift passes are not included and remain the Client's responsibility. Protective equipment beyond the helmet is strongly recommended and available for hire through our partner.
Participants using their own equipment are responsible for its condition and suitability. APEX may refuse a Participant whose equipment is unsafe.
ARTICLE 10 — Minors and parental authorisation
Any booking for a Participant under 18 must be made by a parent or legal guardian, who thereby accepts these Terms on the minor's behalf.
The person making the booking warrants that they hold parental authority or authorisation to enrol the minor.
For camps and day programmes, the Client must provide an emergency contact reachable throughout the Service, and specify who is authorised to collect the child.
APEX supervises minors only during the stated hours of the Service. Outside those hours, responsibility rests with the parent or guardian.
ARTICLE 11 — Image rights and confidentiality
APEX may take photographs or video during Services for promotional purposes. The Client may object at any time, at booking or subsequently, by written notice, without needing to give reasons and at no cost.
APEX undertakes a strict duty of discretion regarding the identity of its Clients. No Client is named, identified or referred to publicly without their express prior written consent. This undertaking survives the end of the contractual relationship.
ARTICLE 12 — Data protection
Personal data is processed in accordance with the Swiss Federal Act on Data Protection and, where applicable, the European General Data Protection Regulation. Full details are set out in our Privacy Policy, which forms an integral part of these Terms.
ARTICLE 13 — Complaints
Any complaint must be raised with the instructor or with APEX during the Service, so that a solution can be found on the spot.
Any subsequent complaint must be sent in writing to hello@apexalps.ch within 14 days of the end of the Service. Complaints made after that period cannot be considered.
ARTICLE 14 — Governing law and jurisdiction
These Terms are governed by Swiss law.
The parties will endeavour to resolve any dispute amicably. Failing agreement, the exclusive place of jurisdiction is Sierre, Valais, Switzerland.
ARTICLE 15 — Final provisions
Should any provision of these Terms be held invalid or unenforceable, the remaining provisions remain in full force.
APEX reserves the right to amend these Terms at any time. The version applicable is the one in force at the date of booking.
These Terms exist in French and English. In the event of any divergence, the French version prevails.
